1. About these Terms

Welcome to fractallooptheory.com (the “Site”). (“Araco Design Studio”, “we”, “us”, “our”). These Terms & Conditions (the “Terms”) set out the legally binding agreement between you and us when you access the Site, create an account, purchase any goods or services, download resources, or otherwise interact with our community. By accessing or using the Site you confirm that you have read, understood, and agree to be bound by these Terms.

Important: Certain materials on, or supplied through, the Site—including the Coined terms, game prototypes, design files, and draft research papers—are confidential trade‑secret content. Access to such content is conditional upon your agreement to a separate non‑disclosure agreement (“NDA”). If a conflict arises between these Terms and an executed NDA, the NDA prevails for the confidential content.

2. Eligibility & Account Registration

You must be 18 years or older and legally capable of entering a contract to use the Site or hold an account.
Account creation is invitation‑only. We reserve the right to refuse registration or to suspend/terminate an account at any time.
You agree to provide accurate, current information and to keep it updated. You are responsible for all activity that occurs under your login credentials.

3. Confidential Content & Non‑Disclosure

Where the Site labels content as Confidential, Restricted, or similar, you must treat that material as confidential whether or not you have signed a separate NDA.
You must not share, publish, reproduce, distribute, or reverse‑engineer confidential content except as expressly permitted in writing by Araco Design Studio.
The confidentiality obligations survive termination of these Terms until such time as the content lawfully enters the public domain through no fault of yours.

4. Acceptable Use

You agree not to:

harass, threaten, or defame any individual;
upload malicious code or disrupt the Site’s operation;
impersonate another person or entity;
use the Site for any unlawful purpose;
data‑mine or scrape the Site without our written consent.

We may suspend or terminate your access for any breach of these Terms.

5. Intellectual‑Property Rights

All content on the Site—text, diagrams, software, puzzles, video, audio, trademarks, and logos—is protected by copyright, trade‑mark, design‑right, and other IP laws. Unless expressly stated otherwise, all rights are reserved.
Provided you comply with these Terms, we grant you a limited, revocable, personal, non‑exclusive, non‑transferable licence to access and display Site content for your own private, non‑commercial use.

The term “Araco Design Studio”, our logo, and related marks are UK trade marks of Araco Design Studio. You may not use them without permission.

6. User Contributions

If you post, upload, or transmit any material to the Site (“User Content”) you grant Araco Design Studio a worldwide, perpetual, royalty‑free, transferable, sublicensable licence to use, reproduce, modify, distribute, display, and create derivative works from that User Content in any media.
You warrant that you own or control all rights in your User Content, and that it does not infringe any third‑party rights or contain unlawful material.
We may remove or edit User Content at any time at our discretion.

7. Disclaimers

The Site and its content are provided “as is” for information and entertainment only. The theory, games, and resources are not medical, psychological, or financial advice. Before relying on any information you must obtain professional advice appropriate to your circumstances.
We make no warranties that the Site will be error‑free, uninterrupted, or compatible with your hardware/software.

8. Limitation of Liability

To the fullest extent permitted by law, Araco Design Studio shall not be liable for any indirect, consequential, incidental, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, whether in contract, tort (including negligence), or otherwise, arising out of or relating to these Terms or the use of the Site.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Termination

These Terms are governed by and construed in accordance with the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction to resolve any dispute.
